"happening now" starts right now. jon: a fox news alert. breaking news now on the deadly terror attack on the u.s. consulate in libya. fox news sources telling us cia officers on the ground in benghazi during the attack sent requests for help but were denied. national security correspondent jennifer griffin is live at the pentagon with more on this. jennifer. >> reporter: hi, jon. well sources who were on the ground in benghazi during the attack tell fox news that in fact there were three separate requests to aid not only the attack that was occurring at the consulate and to try to help with that attack but also requests for outside help, outside military help to help once there were gunfire and firefights at the cia annex. those requests, we're told, came from higher headquarters. they were told to stand down. as you know, glen doherty and tyrone woods, the former navy seals were over at the cia annex at about 9:40 p.m. when the first shots were heard at the consulate where the ambassador and his team were taking fire. i'm told that they radioed to their higher headquart

, but what the f.d.a. told us today about that pharmacy came as quite a surprise. here's dr. jon lapook. >> reporter: the food and drug administration tested 50 vials suspected to be a source of con contamination in the meningitis outbreak. they found all 50 were contaminated by bacteria or fungus. the f.d.a. says internal n.e.c.c. documents show the company tested a vial from the same lot in august and labeled it sterile. the inspection also focused on the clean room at n.e.c.c. a clean room like this one is where ingredients are mixed to make sterile medication. the f.d.a. discovered n.e.c.c.'s own monitoring repeatedly found mold and bacteria growing on walls and surfaces. equipment used to sterilize medicine had "greenish-yellow discoloration" and air ducts were dirty. according to the f.d.a., there's no evidence n.e.c.c. did anything to fix the problems. the n.e.c.c. responded today saying "we will review this report and continue our cooperation." >> pelley: jon, thanks very much. we'll look at a key race in the battle for control of the senate. and we have the first video of malal
the story as we look at apple trading at $598.40. jon fortt has been in studio with us all week. you think that perhaps the street is misreading this a little bit. things aren't exactly the way they appear. >> i think as people have taken some time to look deeper into the numbers, listen to apple's commentary last night, a few things are standing out. one, the iphone number, really not that bad based on what some people had been expecting. the older iphones continue to sell pretty well. iphone 4s and 4. then you've got the fact that the ipod and ipad refresh really caused apple to have to make a lot of adjustments. if you look at property plant and equipment in apple's report, what they spent on that doubled year over year. you consider -- i mean that's a big expense. apple's story about why margins are coming down, i think some of the apple bulls at least have latched on to that heading into next quarter. plus the fact that apple forecasted $52 billion in sales for the holiday quarter. not all bad. the question is, this ipad mini, how well will it sell. if that looks big, people might sta
